In addition,&nbsp;You&nbsp;agree to pay for all royalties, fees, and other payments owed to any party by reason of Your&nbsp;transmitting,&nbsp;posting,&nbsp;or submitting User Submissions.&nbsp;ZINPRO&nbsp;DOES NOT ENDORSE ANY USER&nbsp;SUBMISSION&nbsp;OR ANY OPINION, RECOMMENDATION, OR ADVICE EXPRESSED THEREIN, AND THE ZINPRO&nbsp;PARTIES EXPRESSLY DISCLAIM&nbsp;ANY AND ALL&nbsp;LIABILITY IN CONNECTION WITH USER SUBMISSIONS.&nbsp;Zinpro&nbsp;does not permit copyright infringing activities, infringement of rights of publicity, or infringement of other intellectual property rights on its Service, and&nbsp;Zinpro&nbsp;will remove all Content (including User Submissions) if properly notified that such Content or User Submission infringes on another\u2019s rights (see Sections&nbsp;10 and 11&nbsp;below).&nbsp;Zinpro&nbsp;will not necessarily monitor User Submissions.&nbsp;However,&nbsp;Zinpro&nbsp;reserves the right to monitor, alter, edit, or remove Content (including User Submissions) and block users without prior notice and for any reason.&nbsp;Zinpro&nbsp;also reserves sole discretion to decide whether&nbsp;any Content (including a User Submission) is appropriate and complies with these&nbsp;TOU.&nbsp;&nbsp;<\/p>\n\n\n\n<p>On&nbsp;Zinpro\u2019s&nbsp;social media sites,&nbsp;You&nbsp;further represent and warrant that You have the permission of any individuals depicted in photographs, videos, or recordings that You submit to use their likeness and\/or voice, as well as all other legal rights necessary to grant the license&nbsp;above&nbsp;to&nbsp;Zinpro.&nbsp;<\/p>\n\n\n\n<p>You understand that when using the Service,&nbsp;You&nbsp;will be exposed to User Submissions from a variety of sources, and that&nbsp;Zinpro&nbsp;is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Submissions. You further understand and acknowledge that You may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable, and YOU AGREE TO WAIVE, AND HEREBY DO WAIVE, ANY LEGAL OR EQUITABLE RIGHTS OR REMEDIES YOU HAVE OR MAY HAVE AGAINST THE&nbsp;ZINPRO&nbsp;PARTIES&nbsp;WITH RESPECT THERETO, AND AGREE TO INDEMNIFY AND HOLD THE&nbsp;ZINPRO&nbsp;PARTIES&nbsp;HARMLESS TO THE USE<\/strong>&nbsp;<\/strong><\/p>\n\n\n\n<p>Zinpro&nbsp;may, at its sole discretion, disable&nbsp;access or partially disable access to the Service for&nbsp;any users who violate these&nbsp;TOU, including, but not limited to&nbsp;(1)&nbsp;users who submit User Submissions that infringe copyrights, trademarks, rights of publicity, or other intellectual property rights, especially if they do so repeatedly,&nbsp;(2) users who provide&nbsp;false or inaccurate information; (3) users who&nbsp;breach these&nbsp;TOU&nbsp;including any warranties; and (5) users who misuse or challenge&nbsp;Zinpro\u2019s&nbsp;rights in the Content.&nbsp;<\/p>\n\n\n\n<p>6. <strong><strong><strong>RESTRICTIONS ON USE OF THE SERVICE<\/strong><\/strong>&nbsp;<\/strong><\/p>\n\n\n\n<p>In Your members of, or contribute money to any online service or other&nbsp;organization;&nbsp;&nbsp;<\/li>\n\n\n\n<li>post or transmit any worms, viruses, Trojans, or other harmful, disruptive, or destructive files, code, or programs to the Service;&nbsp;or&nbsp;<\/li>\n\n\n\n<li>upload, post, email, transmit,&nbsp;or otherwise make available any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or&nbsp;any other form of solicitation.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Zinpro&nbsp;will fully cooperate with any law enforcement authorities or court order requesting or directing&nbsp;Zinpro&nbsp;to disclose the identity of anyone violating these&nbsp;TOU.&nbsp;<\/p>\n\n\n\n<p>Zinpro&nbsp;believes in children\u2019s online safety and does not wish to receive information regarding children under 18&nbsp;years old.&nbsp;If You are under 18&nbsp;years of age, then please do not attempt to submit any information to or use the Service.&nbsp;<\/p>\n\n\n\n<p>7. <strong><strong><strong><strong>INTELLECTUAL PROPERTY<\/strong><\/strong><\/strong><\/strong><\/p>\n\n\n\n<p>Everything You see, hear, or otherwise experience on THE FOREGOING LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.<\/p>\n\n\n\n<p>THE ZINPRO PARTIES\u2019 MAXIMUM AGGREGATE LIABILITY FOR ANY SINGLE EVENT (OR A SERIES OF RELATED EVENTS) GIVING RISE TO A CLAIM IN CONNECTION WITH THESE TOU OR IN RELATION TO THE SERVICE, EITHER FOR BREACH OF CONTRACT, BREACH OF WARRANTY, MISREPRESENTATION, OR NEGLIGENCE, WILL BE LIMITED TO $50.00.&nbsp;<\/p>\n\n\n\n<p>BY ACCESSING THE SERVICE, YOU UNDERSTAND THAT YOU MAY BE WAIVING RIGHTS WITH RESPECT TO CLAIMS THAT ARE AT THIS TIME UNKNOWN OR UNSUSPECTED, AND IN ACCORDANCE WITH SUCH WAIVER, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND, AND HEREBY EXPRESSLY WAIVE, THE BENEFITS OF SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA, AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY, WHICH PROVIDES AS FOLLOWS: \u201cA GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.\u201d<\/p>\n\n\n\n<p>Any&nbsp;claims relating to use of the Service must be bought within one (1) year from the date the cause of action arose. Claims brought after such period are VOID.&nbsp;The Service is controlled and offered by&nbsp;Zinpro&nbsp;from its facilities in the United States of America.&nbsp;Those who access or use the Service do so at their own volition and are responsible for compliance with local and all other applicable laws, restrictions, and regulations.&nbsp;<\/p>\n\n\n\n<p>16. <strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong>ASSIGNMENT<\/strong>&nbsp;<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/p>\n\n\n\n<p>The&nbsp;TOU, and any rights and licenses granted hereunder, may be transferred or assigned by You only with&nbsp;Zinpro\u2019s&nbsp;prior written consent, but may be assigned by&nbsp;Zinpro&nbsp;without restriction and without notice to You.&nbsp;<\/p>\n\n\n\n<p>17. <strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong>CLASS ACTION WAIVER<\/strong>&nbsp;<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/p>\n\n\n\n<p>ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION OR AS A NAMED OR UNNAMED MEMBER IN A CLASS, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL LEGAL ACTION.
